So, as is my nature, working multiple angles, I called Next-Bike a few times, and they finally called me back, and are sending me a new crank and pedals, free of charge. The bikes come with a 2 year warranty, but they didn't ask for proof.

Hope this helps anyone else who had components fail on their Next-Bike!

Just an addition to this make sure you specify the size 24",26", etc.
